Alternative Dispute Resolution

Overview

If you are seeking an effective alternative to traditional courtroom litigation, Chasan Lamparello Mallon & Cappuzzo, PC offers extensive experience in arbitration and mediation, collectively known as Complementary Dispute Resolution (CDR) and Alternative Dispute Resolution (ADR). These methods can often provide a more efficient, cost-effective, and flexible path to resolving disputes throughout New Jersey.

ADR and CDR processes are commonly utilized in a wide range of matters where parties seek to avoid the time, expense, and formality of traditional litigation, including:

  • Commercial and contractual disputes
  • Insurance coverage and liability matters
  • Medical malpractice matters
  • Personal injury matters
  • Employment-related disputes
  • Construction and development matters
  • Complex or multi-party litigation requiring streamlined resolution

Arbitration is a settlement technique that is generally faster and less costly than a formal courtroom trial. In arbitration, a neutral hearing officer (not a judge) hears the case and renders a decision without a jury. While not every matter is suited for arbitration, our attorneys have the experience to evaluate when and how this approach can be used to achieve the best possible outcome.

Mediation is a voluntary, non-binding process that focuses on resolving disputes through bargaining or settlement dialogue. With the assistance of an impartial facilitator or mediator, parties engage in guided discussions aimed at reaching a mutually acceptable resolution. The mediation process offers flexible opportunities for resolution while allowing the parties to maintain greater control over the outcome.

Our attorneys regularly serve as arbitrators for the U.S. District Court of New Jersey-sponsored CDR, on private arbitration panels, and in attorney-client fee dispute matters. The Firm is frequently appointed by judges in Hudson, Essex, Bergen, and Passaic Counties to serve as Special Masters in complex, multi-party cases. Our attorneys also contribute to the continued development and implementation of modern CDR practices through active participation in bar association committees focused on dispute resolution.
