Education Law
Overview
In the expansive field of education law, our experience as general and labor counsel to boards of education allows us to provide representation across all aspects of the discipline. This includes public contracting, labor law and negotiations, employment matters, employee discipline, discrimination claims and investigations, construction issues, student discipline, tenure, residency, special education, employee leave, public records, and Americans with Disabilities Act matters. At Chasan Lamparello Mallon & Cappuzzo, PC, we work daily with board of education members, superintendents, and administrative staff to protect each board’s economic and legal interests.
We serve as Board Counsel to the Bellmawr, Bogota, East Rutherford, Lyndhurst, Morris Plains, Rockaway and Sea Girt Boards of Education; as Labor Counsel to the Cranford, Morris Plains and North Caldwell Boards of Education; and as Special Counsel to the Bergen County Special Services School District, Bergen County Vocational School District, Lyndhurst, Nutley, Riverdale, Summit and Waldwick Boards of Education.
The Firm has appeared before the Supreme Court of New Jersey, addressing the constitutionality of the New Jersey Charter School Act in Re: Charter School Application of Englewood et al, 164 N.J. 316 (2000). The Firm also successfully represented the Clifton Board of Education in a precedent-setting Appellate Division case entitled Board of Education of the City of Clifton v. Zoning Board of Adjustment of the City of Clifton, 409 N.J. Super. 389 (App. Div. 2009).
Attorneys in the Firm also regularly appear before the Superior Court of New Jersey, United States Federal Courts, the Department of Education, and the New Jersey Office of Administrative Law on a variety of school law-related issues.
