Several attorneys from CLMC's Defense Department received honors and presented seminars at the 2024 New Jersey Defense Association Annual Convention in Manchester, Vermont.
John V. Mallon received the prestigious Attorney of the Year Award and Ellen L. Camburn received the Young Lawyer of the Year Award. Both awards are given to those who have made substantial contributions to the New Jersey Defense Association and the legal community. John has been a member of the NJDA for more than twenty five years, and has served as its President and as Chair of its Board of Directors. Ellen was honored for her service to the Philanthropy Committee of the NJDA and for her excellent trial work.
Nicole R. Cassata gave a presentation on recent caselaw, including the case she recently argued before the Supreme Court of New Jersey on behalf of the NJDA, Goyco v. Progressive Insurance Company. In a unanimous decision, the Supreme Court agreed with Nicole's amicus curiae brief, ruling that a low speed electric scooter (LSES) rider does not fall within the definition of “pedestrian” for purposes of the No-Fault Act and therefore is not entitled to PIP benefits. The Court held that while expanding the definition of “pedestrian” to include LSES operators would advance the medical coverage goal, it would undermine the goal of curbing the rise of insurance costs.
Additionally, Robert A. Cappuzzo organized the official NJDA cornhole tournament at the convention.
The NJDA establishes a communication link among New Jersey defense attorneys, insurance claim professionals, self-insurers and other corporations who devote a substantial portion of their time to the defense of damage suits or to claims administration. The NJDA also encourages the prompt and fair resolution of claims, as well as the enhancement of the knowledge and skills of defense attorneys through various educational and legal programs.
