PETER L. MAC ISAAC
Peter L. MacIsaac specializes in personal injury, commercial and chancery litigation. Peter has successfully prosecuted and defended claims involving medical malpractice, products and premises liability, driver negligence, breach of contract, misappropriation, theft of trade secrets, lack of capacity and undue influence, invasion of privacy and infliction of emotional distress.
In addition to obtaining awards and resolving matters on behalf of parties involved in commercial disputes and personal injury matters, Peter has successfully argued before the Appellate Division of the Superior Court of New Jersey, the Supreme Court of New Jersey, the United States District Court for the State of New Jersey, and the United States Court of Appeals for the Third Circuit.
In 2005, Peter was instrumental in bringing about the United States Court of Appeals for the Third Circuit’s precedent setting interpretation of the Computer Fraud and Abuse Act ("CFAA"). The CFAA is a federal criminal statute containing civil remedies addressing computer hacking and virus spreading. The Court’s November 7, 2005 Precedential Opinion in the matter Party City v. Celebrations, et al., 428 F.3d 504, C.A.3 (N.J.), (NO. 04-4254) dealt with a Plaintiff who sought an injunction closing the business of its competitor, by claiming violations of the CFAA in the form of computer hacking and theft of trade secrets by one of its competitors partners. Peter successfully defended the individual partner charged with hacking by deposing the plaintiffs, preparing the briefs and arguing before the Federal District Court for the State of New Jersey and the United States Court of Appeals for the Third Circuit. The Court affirmed the District Court's decision denying Plaintiff’s application and adopted Peter’s argument that the Plaintiffs failed to adduce sufficient proof of a violation under the CFAA and were therefore not entitled to injunctive relief.
