Roosevelt Jean obtained a Summary Judgment victory on behalf of the Township of North Bergen. Plaintiff alleged that while doing chin-ups on a seven foot bar at Bruin Stadium, the bar suddenly collapsed and he injured his spine requiring spinal fusion. Plaintiff also alleged the need for future spine surgery, permanent neurological injuries and disability. Plaintiff and the product manufacturer brought suit against the Township of North Bergen, alleging negligent maintenance and inspection of Township property. Mr. Jean showed the Court that plaintiff and the product manufacturer failed to prove North Bergen’s liability under N.J.S.A. 59:4-2. Vindicating the Township of North Bergen, the Court held that a reasonable jury could not find North Bergen’s inspection program amounted to “palpably unreasonable” conduct.
