Ralph J. Lamparello, with the assistance of Raymond J. Seigler, successfully defended C.H. Martin, Inc., a private chain of department stores, against a claim of public accommodation discrimination pursuant to New Jersey’s Law Against Discrimination in a jury trial before the Hon. Hector R. Velazquez, J.S.C. in the Superior Court of New Jersey, Hudson County. Plaintiff alleged that C.H. Martin unlawfully discriminated against him on account of his sexual orientation because it failed to timely reprimand an employee that referred to him by a derogatory epithet on multiple occasions. Mr. Lamparello convinced the jury that C.H. Martin was entitled to a judgment of no cause for action because plaintiff was not subjected to an “actual or apparent design” to discourage his patronage.
