On October 2, 2017, the Tax Court of New Jersey issued an opinion and final judgment that upheld a municipal property tax appeal settlement between BMW of North America, LLC (BMW), a Woodcliff Lake Borough (Woodcliff Lake) commercial property owner, and Woodcliff Lake. The Court’s unpublished opinion, authored by the Hon. Joshua D. Novin, J.T.C., concludes that Woodcliff Lake’s Mayor Carlos Rendo and Council did not act in an arbitrary, capricious or unreasonable manner in its property tax appeal settlement with BMW. As such, the Court dismissed Plaintiff William E. Dolan’s resident taxpayer challenge with prejudice. This Court’s decision is important to the Woodcliff Lake taxpayers because it provides municipal valuation and budgetary certainty moving forward and eliminates the cost and uncertainty of litigation.
