COMPLEMENTARY DISPUTE RESOLUTION
We have in-depth experience with both arbitration and mediation, known as Complementary Dispute Resolution (CDR). We use this as an alternative to “going to court.”
Arbitration consists of a mini-trial, before a hearing officer (not a judge), who hears and decides your case without a jury. Arbitration is much less formal than a courtroom trial and may proceed more quickly and less expensively than a
traditional trial. Not all cases are appropriate for determination through arbitration. As adept trial attorneys, we know how and when to use arbitration to the best advantage of our clients, plaintiff or defendant.
Mediation is a voluntary process to resolve disputes through bargaining or settlement dialogue, assisted by a facilitator or mediator. The mediation process is not binding. This process works best when both counsel and client desire a fair resolution.
In addition to representing our clients at arbitration and mediation, our attorneys regularly serve as arbitrators for court sponsored CDR, on private arbitration panels and in lawyer/client fee disputes. Members of our firm are frequently appointed by judges of Hudson, Essex, Bergen and Passaic Counties to act as Special Masters in complex and multi-party cases. We have also been instrumental in the development and implementation of CDR practices through participation in numerous bar association committees in this field. Joel A.
